We are Club WPress, a subscription service to access WordPress themes and plugins created and redistributed under GPL license (General Public License) by developers around the world. When we say “we,” or “us,” we refer to the Club WPress located at https://clubwpress.net.
Account creation:
When you create an account and accept these terms, you become a member of our community. During your time with us, you agree to follow the basic rules set out in these terms. Please read them carefully and understand them.
Acceptance of conditions:
If you do not accept the terms, you will have to leave as acceptance of these terms is necessary to continue using the Club WPress site. You also agree to our privacy policy, whether you become a member or not.
Subscription:
When you subscribe, you access our directory of items subject to the GPL license. Only real people, using their real identity, name, first name, legal status can subscribe to Club WPress .
Age:
You must be at least 18 years of age to become a subscriber. If you are under 18, you must use the account of a parent or legal guardian who is at least 18 years old. You must also have his/her permission. This adult will be responsible for your actions.
Your responsibility:
You promise that the information you provide to us is true, accurate and complete and that you will keep your account information up-to-date (including a recent email address). Your subscription is not transferable. You are responsible for any use of Club WPress made with your username and password. So protect your password and do not let anyone else have access to it. If you realize there has been unauthorized use of your account or a security breach, you must notify us immediately.
Refunds:
Given the nature of digital content that can be instantly downloaded after a purchase; there is no “trial period” or “grace period” after the purchase of a subscription, which means that all sales are final. Once you have downloaded an item, there is no way to “return” it. As such, refunds can only be made if we have made changes to these conditions. In this case, a prorated refund will be provided for any unused months.
Refund requests :
We will assess claims on merits, but generally there is no obligation to repay if:
- You have changed your mind
- You have subscribed by mistake
- You ask for good will
- You lack the technical ability to operate the item
- You can no longer download the item because it has been removed from our website
- You are violating our policy of using files
Product Support:
The nature of WordPress plugins and themes means that the elements are provided “as is”, with no implied warranty that they will work exactly as you wish or with all third-party components and plug-ins. We are not able to provide technical support for downloads. The third party products provided are supported by their authors and not by the Club WPress . Please review support conditions provided by the author of a product before purchasing any item from us. Our support is limited to billing and / or technical requests for the Club WPress.net website only.
Product updates:
When you sign up, you are billed on a recurring basis (monthly or yearly) until you cancel, which you can do at any time. If you cancel your subscription, you will no longer receive updates for plug-ins or themes downloaded from the Club WPress , unless you renew your subscription. However, you may continue to use the elements in accordance with the terms of GPL license.
Policy for use of files and good behavior:
Your use of Club WPress must comply with our policy for use of files and good conduct. Being a subscriber is not an automatic right, it is an advantage for those who follow our rules. We hope you will be with us for a long time. However, we can decide whether your use of Club complies with these conditions or not. We may suspend or terminate your Subscription Account at any time for any justified reason, including if you violate the following rules
- you are acting in a way that does not correspond to the values of our community
- you are acting in a way that could harm ourselves or others.
If we decide to permanently cancel your Club WPress account, you must not request a new account, as you will no longer be welcome.
No refunds will be provided to customers whose accounts are terminated. Examples of reasons for termination may include:
- Abusive and / or excessively negative behaviour towards our staff and / or other clients;
- Repeated defamatory, malicious and / or false statements, including slander against us, and / or attempts to dissuade potential customers from buying our products;
- Promotion of competing products, contribution to software piracy, hacking, spam or other illegal acts;
- Attempt to circumvent our fair use policy (see below)
Fair Use Policy:
We apply a fair download policy. Subscribers can download 25 articles per day. Attempting to download a large number of items concurrently or bypassing this rule may result in suspension and / or termination of your account.
Membership and / or price changes:
We do not ensure that a particular article will continue to be available on our website. We reserve the right at any time to modify or discontinue all or part of the downloads without notice. On the contrary, we are also adding new downloads. Product prices are subject to change at any time, these changes will be posted on our website and will not affect current subscriptions.
Connections:
We have not reviewed all sites linked to this website and we are not responsible for the content of these sites. The inclusion of a link does not imply our approval.
Trademarks, Copyrights and Intellectual Property Claims:
We respect the intellectual property rights of others. If you believe that a Club WPress item or content infringes an intellectual property right, please review the information in our copyright policy.
Liability and compensation:
All losses, costs (including court costs on a full compensation basis), expenses, claims that we incur in connection with or related to the use of Club WPress will be your responsibility.
The Club WPress and the elements of the website are made available to you “AS IS”. We make no warranty, including any implied warranty of non-infringement, merchantability or fitness for a particular purpose.
Our liability to you in connection with the Club WPress is limited as follows:
We are not responsible for all things that you have incurred: loss of revenue, loss of profit, loss of customer, loss of customers, loss of capital, damage to reputation, loss of any other contract, loss of data or, loss , damage or consequential or special expenses; etc …
Our liability to you is otherwise limited to the total amounts you paid us for your subscription within the last 6 months, immediately preceding the date on which your complaint was filed.
Availability:
Club WPress is available 24 hours a day. Sometimes you may not be able to access Club WPress. This can happen for any reason, at any time, with or without notice. We may also change certain aspects of operation in Club WPress , including the types of items available on our site. We will not be liable to you for losses you suffer as a result of these actions.
Third party:
If you accept these terms in someone else’s name, you are promising us that you have full legal authority to engage that third party. Remember that only real people can subscribe to the Club WPress.
Disabling your subscription or refusal to process a payment:
We may block, terminate your subscription or refuse to process a payment if we reasonably believe that there is a risk associated with you, your subscription or such payment. We reserve the right to do so if a payment comes from a country or person sanctioned by an authority (such as the United Nations or European Member States); or where we reasonably believe that there is a legal or regulatory risk. You promise not to be in a sanctioned country and not to be on a sanctioned list. We can also block members of a country if we can not make payments to or from this country. You need to check which payment methods are available in your country to make payments. We may take any action set out in this section without notice. As our site is global, different laws may apply, which may restrict our relationship with you.
Relationship between the parties:
Nothing in these Terms shall be construed as constituting a partnership, joint venture, employment or agency relationship between you and us, or between you and any other member. Neither you nor we can bind ourselves in any way.
Review:
Any notification you send to us must be submitted by email. Any notification we send to you will be emailed to the email address you provided to us.
Changes of terms:
We may change these terms at any time and, if we make changes, we will take steps to inform our subscribers. You can also find out if any changes have been made to our terms by referring to the date-at-footer version of the terms. If a change we make has a material effect on you to your detriment, you may, after showing such prejudice, cancel your subscription in accordance with the “Refunds” section above. However, if you continue to use Club WPress once the changes are made, you accept these changes regardless of the time elapsed.
